1. U.S. laws and regulations must conspicuously permit free and unfettered distribution of products
manufactured under authority of the U.S. trademark owner.
2. Counterfeiting, counterfeiters and counterfeit products must be aggressively fought against and severely
punished.
3. Congress, the Courts and the USTR must not broaden existing intellectual property protections in order
to eliminate competition in the marketplace.
4. No property rights are infringed when genuine brand-name products that are safe, unadulterated and
otherwise of great benefit to American consumers are imported into and distributed freely within the United
States.
5. The United States must not permit manufacturers to exploit U.S. consumers through discriminatory
pricing schemes and product manipulation.
6. Federal and state agencies must be encouraged to make publicly available all information necessary to
ensure product integrity and facilitate product distribution to consumers throughout the country.
7. All American consumers, regardless of income, nationality or where they live, deserve access to
authentic brand name merchandise.
8. Alternative sources of consumer goods foster competition and provide incentives against monopolistic
control of the domestic marketplace.
9. Legislators and regulators must support, favor and pass laws that provide American consumers with
greater product choice, greater product availability and a fully competitive marketplace.

The American Free Trade Association (AFTA™) is the only trade association in the
United States fighting on behalf of the secondary marketplace. Through the strong
leadership of its Board of Directors, AFTA has worked tirelessly to acquire an
unparalleled record of success defending the industry for many, many years. Now,
however, the opposition is stronger and is fighting us on many different fronts
simultaneously, any of which could be fatal to the trade.
